Hudson Valley — Since 1987

We have represented Hudson Valley families in estate and business matters since 1987.

Three decades of work in Ulster County courts and offices gives us context that takes years to build. We are straightforward about what the law allows, what it does not, and what the likely outcomes are.

The Firm

Founded on the belief that most legal problems are solved by clear thinking, not complex maneuvering.

Robert Hartwell opened this office in 1987 in a second-floor walk-up on Wall Street in Kingston, two years after passing the bar. His first clients were neighbors — a couple settling a parent's estate, a contractor forming his first LLC. He stayed small on purpose. His reasoning was simple: a smaller practice means every partner knows every file.

The firm has grown since then, but the structure has not changed. Four attorneys. A paralegal team. One office. We do not take every case that walks in the door. We take the ones where we can give an honest answer about the likely outcome, and where the client is prepared to hear it.

Most of our clients come back. Many send their children. That pattern is the result of one practice: we tell people what we actually think, not what they want to hear.

We tell you what we think. Not what you want to hear. That is why clients come back.

Practice Areas

What we handle

Estate Planning

Wills, trusts, health care proxies, and powers of attorney. We help you put a plan in place while the decisions are still yours to make, not the court's.

Probate and Trust Administration

When a family member passes, we guide the executor or trustee through the legal process — inventory, creditor notifications, distributions, and final accounting.

Business Law

Formation, operating agreements, partner disputes, asset purchases, and succession planning. We advise businesses from startup through ownership transition.

Civil Litigation

Contract disputes, property disagreements, and tortious interference claims in New York State courts. We litigate when negotiation has reached its limit.

Real Estate Transactions

Residential and commercial closings, title review, contract negotiation, and landlord-tenant matters in Ulster and Dutchess counties.

He lives in Woodstock with his wife and their two dogs.

Client Voices

What clients say

My father passed without a clear will, and we were looking at a long probate. Robert walked us through the process in plain language, kept us out of court, and had the estate settled in four months. I expected a nightmare. It was not.
Margaret T.
Estate administration, Kingston
Patricia took our contractor dispute seriously from the first call. She was direct about our odds, helped us decide litigation was the right call, and we won at trial. No guarantees were made and no corners were cut.
James and Carol Bauer
Civil litigation, Rhinebeck
We hired Daniel to structure the sale of our manufacturing business. He asked questions I had not thought to ask, caught a tax exposure in the purchase agreement that would have cost us significantly, and closed the deal on time. Steady, thorough, no drama.
Victor Alvarez
Business sale, Saugerties

Common questions

Online will templates are legal in New York if properly signed and witnessed, but they are generic documents that do not account for your specific assets, family dynamics, or tax situation. A common problem we see: online wills that name beneficiaries without considering how those assets are already titled, which means the will is overridden by a beneficiary designation no one remembered. A consultation costs far less than sorting out the estate later.

A straightforward estate with a clear will, no contested creditors, and cooperative beneficiaries typically closes in four to eight months in Ulster County. Contested estates, estates with real property in multiple states, or those involving business interests can take two years or more. The best way to shorten the process for your family is to have a well-drafted plan in place now.

A will takes effect at death and goes through probate, which is a public court process. A revocable living trust holds your assets during your lifetime and transfers them to your beneficiaries without probate. Trusts are private, often faster, and useful when you own property in more than one state. Which one is right for you depends on your assets, your family, and your goals. We can walk through both in a single consultation.

Yes. Most disputes between partners or with customers resolve through negotiation or mediation before a lawsuit is filed. We prefer that outcome when it is achievable because it costs less and takes less time. That said, some disputes only resolve when the other party understands that litigation is a real possibility. We are direct with clients about which situation they are in.

Yes. We represent buyers and sellers in residential closings throughout Ulster and Dutchess counties. We review purchase contracts, conduct title searches, handle lender requirements, and attend the closing. If you are buying a property with a septic system, well, or easements, we flag those specifically because they come up frequently in this area.
